BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2022 MetroDesk Media, LLC) — A Boca Raton woman is suing United Airlines, claiming that flight attendants were negligent when they permitted a piece of passenger luggage to protrude into the aisle — causing her to trip.

Lynn Goldberg claims that she and her husband Roger were flying on United 2261 from Fort Lauderdale to Houston on February 18, 2021. There were sitting in seats 8E and 8F, identified as economy on the 737.

“Approximately 45 minutes into the flight, when all safety signs and in-flight announcements authorized passengers to move about the cabin, Ms. Goldberg got up out of her seat to walk to the back of the plane and use the restroom. At this time, the interior cabin lighting was still turned down and the walkway was illuminated by green lights on the floor. Ms. Goldberg had travelled approximately 3 rows from her assigned seat when her right foot struck a dark, hard piece of luggage that was sticking out into the aisle.”

The suit alleges that United Airlines Flight Attendants failed to ensure that passengers were complying with FAA mandates concerning bag storage, failed to perform safety checks, failed to keep the aisle free and clear of obstruction, and failed to appropriately train its flight crew to follow federal rules and regulations.

Attorneys for Ms. Golderberg say she suffered serious, permanent injuries as a result of her fall which occurred after she tripped on the luggage in the aisle. The suit seeks in excess of the $30,000 statutory minimum for filing in Palm Beach County Circuit Court. She is represented by Attorney Jason Scarberry of McFarlane Law in Coral Springs.

United Airlines had not filed a response to the suit as of early Friday morning, May 6, 2022.
