Ticket seller refuses to give refund for a show that may never go on - NJ.com

Caesar Fiorini was planning ahead.

His wife’s birthday was coming up in March, so in January, he decided to plan a nice surprise.

“My wife is a big dance fan and had never seen Riverdance,” the Maywood man said.

So he purchased two tickets from TickPick.com for a March 14 show at Radio City Music Hall in New York City, totaling $360.

Then the coronavirus outbreak shut down the city, closing Broadway and leaving would-be theatergoers holding tickets for shows that may never happen.

“The (Riverdance) production team has canceled all New York City shows until at least spring 2021,” Fiorini said. “That wait is over a year and even then it may never be rescheduled.”

He asked TickPick for a refund.

Fiorini emailed the company multiple times. and it basically gave the same response each time.

The event was not officially canceled and may be rescheduled, so Fiorini is not yet due a refund, it said.

That wasn’t good enough to Fiorini, who said even if it is rescheduled, what if they’re not available to attend? What if they don’t feel safe at a crowded show?

He asked Bamboozled for help.

The Riverdance team indeed is planning to reschedule dates, when possible, sometime in 2021.

“Rescheduled dates are announced once confirmed and all tickets will remain valid, however, please contact your point of purchase for refund policy if required,” it said.

We examined the TickPick policy to see when and if Fiorini might be due a refund.

Its policy said if an event is canceled, ticket holders have a choice of a credit worth 100% of the ticket value or they can receive a full refund.

Its special COVID-19 page, the company repeats its refund policy.

“If your event has been cancelled, you will be notified via email with details on how the credit and refund process works,” it said. “If the event is postponed, suspended or rescheduled for a later date, refunds will not be available, as your tickets will still be valid for the new date.”

And if you can no longer use the tickets or no longer want to attend because of the virus, you can re-list them for sale on the TickPick website, it said.

We asked TickPick if it would reconsider, especially given that Broadway, just this week, said it would remain closed until late winter and early spring and theater owners would refund tickets through Jan. 3, 2021.

A TickPick spokesperson said in an email that Riverdance is not considered Broadway.

That may be true, but a theater event is a theater event, no matter the size of the venue or the kind of performance. It’s not like non-Broadway shows are back on.

“The decisions of Broadway do not apply to the broader live event ecosystem,” the spokesperson said, noting that as a secondary ticket seller, TickPick does not make official event decisions.

The spokesperson said the tickets are still valid because the event was postponed and not canceled, so a refund isn’t happening at this time.

“We understand Mr. Fiorini’s frustration, and should the event status update to `canceled’ he will receive an email outlining the reimbursement options, which include a full refund,” the spokesperson said.

Fiorini said he’s disappointed in the response.

“For health reasons I would not go into New York City this year or anytime soon,” Fiorini said. “Hopefully it will be cancelled and then I can get refunded. Otherwise I’d have to try and sell them.”
